Abstract

This research dealt with an important topic that has a significant impact on ijtihad (independent reasoning) and that is the value of conclusiveness and speculation in scientific issues on the ijtihad process.

The first topic explained the concept of the conclusive text and the speculative text, and the second topic dealt with the words related to it. As for the third topic, it talked about the Shariatic texts between conclusive and speculative texts, and the fourth topic addressed the impact of scientific conclusiveness and speculation on ijtihad.

The researcher reached many results, the most important of which is that the saying that scientific means are definitive generated a state of agreement among scholars when applied to many facts, such as the minimum duration of pregnancy and the maximum duration of pregnancy.

The researcher made some recommendations, including that the competent authorities need to establish jurisprudence academies and special institutions that make it possible, through specialists, to find solutions to emerging issues in the jurisprudential arena.
